CNYHSA CONFIDENTIALITY POLICIES

HIV Care Network

HIV/AIDS is recognized as a disability by the federal Americans with Disabilities Act. The New York State HIV Confidentiality Law (Article 27-F) affords additional protections for those living with HIV/AIDS. The Central New York HIV Care Network and the Central New York Health Systems Agency which manages the Network contract from the AIDS Institute, have established the following procedures to ensure that the confidentiality of any participating Person Living with HIV/AIDS is protected.

CNYHSA staff receive annual training in HIV Confidentiality Law and sign a statement each year affirming their agreement to adhere to the provisions of the Law.

CNYHSA receives and transmits client HIV information only in accordance with Release of Information form(s) approved by the New York State Department of Health. Information is shared only with those who have a legitimate need to know in connection with the delivery of services.

Individuals joining the Central New York HIV Care Network complete an application form and an accompanying Network Member Confidentiality Pledge whereby they agree to respect the confidentiality of other participating members.

HIV-positive individuals who join the Network’s Consumer Advisory Committee complete an application form and an accompanying Network Member Confidentiality Pledge whereby they agree to respect the confidentiality of other participating members.
